These terms and conditions shall apply to the agreement between skinsforiphone.com and the individual or company ("You") applying for the purchase of the product.

  4. These terms and their performance shall be governed by and construed in accordance with the laws of England and Wales and the parties hereby submit to the exclusive jurisdiction of the courts of England.
  5. You shall comply with all foreign and local laws and regulations which apply to your use of the service in whatever country you are physically located, including without limitation, consumer law, export control laws and regulations.
  6. You agree that because of the unique nature of the service and skinsforiphone.com's proprietary rights therein, a demonstrated breach of these terms by you would irreparably harm skinsforiphone.com and monetary damages would be inadequate compensation. Therefore, you agree that skinsforiphone.com shall be entitled to preliminary and permanent injunctive relief, as determined by any court of competent jurisdiction to enforce the provisions of these terms.
  7. Any failure by any party to these terms to enforce at any time any term or condition under these Terms will not be considered a waiver of that party's right thereafter to enforce each and every term and condition of these terms.
  8. Neither party will be responsible for delays resulting from circumstances beyond the reasonable control of such party, provided that the non performing party uses reasonable efforts to avoid or remove such causes of non-performance and continues performance hereunder with reasonable dispatch whenever such causes are removed.
  9. Nothing in these Terms shall give, directly or indirectly, any third party any enforceable benefit or any right of action against skinsforiphone.com and such third parties shall not be entitled to enforce any term of these terms against skinsforiphone.com.
  10. skinsforiphone.com has the right to change this agreement at any time. Any changes will be posted here and it is your responsibility to check for changes. Continued use of the Service after any such changes shall constitute your consent to such changes.

2. Fees

  1. The fee must be paid before the product may be downloaded.
  2. All payments are non-refundable.
  3. Payment is taken in Pounds Sterling and you are responsible for the final amount in whatever currency your banking is handled.

3. The Product

  1. You may use the product on no more forums as you have purchased skin licenses for. A forum is defined as a "production" installation of the relevant forum software for which the skin has been purchased, whether privately accessible or not.

  2. You may install a second copy of the skin for testing purposes on a private forum.
  3. Any product provided is not guaranteed to be correct or free from error.
  4. skinsforiphone.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, any product (or any part thereof) with or without notice.
  5. skinsforiphone.com shall not be liable to you for any modification, price change, suspension or discontinuance of any product.
  6. You may not use any product for any illegal purpose.

4. Termination

  1. skinsforiphone.com reserve the right to decline your order for any reason without notice.

5. Warranties & Liabilities

  1. You can recover from skinsforiphone.com only direct damages up to an amount equal to the amount paid for the product.
  2. In no event shall skinsforiphone.com be liable for any special, indirect, incidental or consequential damages, including loss of profits and goodwill, business or business benefit above the value of the amount paid for the product.
